User Agreement
This User Agreement outlines the terms and conditions governing the use of Celebrate Vacation’s services and products. This agreement applies to any person who inquires about or purchases services from Celebrate Vacation through its various sales channels, including our website (celebratevacation.co), mobile applications, salespersons, offices, call centers, branch offices, franchisees, and agents.
By accessing, browsing, or utilizing any of Celebrate Vacation’s services, you acknowledge that you have read, understood, and unequivocally agreed to be bound by this User Agreement. If you do not agree with any part of this agreement, you must refrain from using Celebrate Vacation’s services.
1. Applicability
This User Agreement, along with our Terms & Conditions, Privacy Policy, Payment Security Policy, Disclaimer, and Cancellation & Refund Policy, forms the complete terms and conditions governing all dealings and transactions between the User and Celebrate Vacation. You are expected to read and understand this agreement before using any services or accessing our sales channels.
2. Eligibility to Use
Users must be at least 18 years of age and possess the legal authority to enter into a binding agreement. Minors (under 18) are not permitted to register or transact on the Website. If a minor wishes to use the Website, it must be done by a legal guardian or parent. Celebrate Vacation reserves the right to terminate membership or block access if it’s discovered a user is a minor or incompetent to contract, or if age information provided is false. This aligns with Google Ads’ protective measures for children and teens.
3. Website Content and Intellectual Property Rights
Celebrate Vacation utilizes various forms of content across its Sales Channels, including images, audio, software, text, and icons. While some of this content, such as certain images, may be sourced from free or licensed third-party providers and is not registered by Celebrate Vacation, our own proprietary logos, service marks, and trademarks displayed on the Website or other Sales Channels are owned by Celebrate Vacation and protected by applicable intellectual property laws. No license or right to use Celebrate Vacation’s proprietary content is granted to the User. Unauthorized use of such content constitutes a violation of applicable law.
You are granted a limited, non-exclusive, non-transferable right to use the Website solely as expressly permitted by this agreement. You agree not to distribute, exchange, modify, sell, or transmit any content from the Website for unauthorized business, commercial, or public purposes.
4. Website Usage
The Website is intended for lawful use by bona fide Users. You agree not to interrupt or attempt to interrupt the Website’s operation.
Access to certain features may require registration, which may involve providing personal information. You warrant that all information supplied is true, accurate, current, and complete.
Celebrate Vacation can terminate access to the Website or services at any time without notice for maintenance or other reasons. While we endeavor to keep content free of viruses, any downloaded data is at your own risk, and you are solely responsible for any damage or data loss. Celebrate Vacation reserves the right to make improvements or changes to the Website without prior notice.
You are requested to report any unlawful, objectionable, libelous, defamatory, obscene, harassing, privacy-invasive, abusive, fraudulent, religiously offensive, spam, or legally violative content to hotels@celebratevacation.co.
5. Prohibited Information on Website/App
You shall not host, display, upload, publish, transmit, or share any information that:
- Belongs to another person without right.
- Is obscene, pornographic, pedophilic, invasive of privacy, insulting based on gender, racially/ethnically objectionable, related to money laundering/gambling, or promotes enmity between groups with intent to incite violence.
- Is harmful to a child.
- Infringes any patent, trademark, copyright, or other proprietary rights.
- Deceives or misleads about message origin, or knowingly communicates false/untrue/misleading information.
- Impersonates another person.
- Threatens India’s unity, integrity, defense, security, or sovereignty, friendly relations with foreign states, or public order, or incites cognizable offense, or is insulting to another nation.
- Contains software viruses or other computer code designed to interrupt, destroy, or limit platform functionality.
- Violates any law in force.
These prohibitions directly align with Google Ads’ policies against dangerous products, content enabling dishonest behavior, and inappropriate content.
6. Procedure to Report Objectionable/Infringing Content
You can report any unlawful or objectionable content on the Website/App. Complaints should be submitted to hotels@celebratevacation.co and clearly identify violations, location of material (including link), proof of IP ownership (for IP violations), and contact information.
By submitting a complaint, you consent to Celebrate Vacation sharing complaint contents with necessary third parties to determine rights and liabilities. Celebrate Vacation will make commercially reasonable efforts to resolve complaints within the prescribed timeframe, provided all relevant information is supplied. Celebrate Vacation is not liable for its acts or omissions pursuant to a complaint, and such acts do not imply admission of liability.
7. Bookings by Travel Agents
Travel agents, tour operators, consolidators, or aggregators are prohibited from using the Website for commercial or resale purposes without prior registration as B2B agents, priority partners, or franchisees, and explicit permission from Celebrate Vacation. Celebrate Vacation reserves the right to cancel such bookings immediately and withhold payments or refunds.
Celebrate Vacation is not liable for incidental loss or damage from bookings made by such Travel Agents; liability rests solely with the Travel Agents. Discounts and offers are applicable only to legitimate bookings by Celebrate Vacation Users.
8. Limited Liability of Celebrate Vacation
Celebrate Vacation primarily acts as a facilitator or technology platform, connecting Users with independent third-party service providers such as airlines, hotels, bus operators, cab operators, tour suppliers, and cruise providers, unless explicitly acting as a direct reseller for a particular service.
Our liability is strictly limited to providing a confirmed booking. Any issues, deficiencies, or disputes arising during the actual availment of services (e.g., service standards, quality, fitness, or availability of services, delays, cancellations by the provider, personal injury, loss, or damage) are the sole responsibility of the respective Service Provider. You understand that the ultimate contract for the provision of travel services is directly between you and the Service Provider. Celebrate Vacation is not liable for inaccurate, inadequate, obsolete, or unlawful information provided by the Service Provider. This clear statement of our role helps manage expectations and aligns with Google Ads’ transparency requirements.3
9. User’s Responsibility
You must carefully check service and product descriptions before booking and are bound by booking confirmation conditions. If booking on behalf of another, you must inform that person of these agreement terms.
You undertake to abide by all procedures, guidelines, and applicable laws/regulations related to Celebrate Vacation’s services. Services are provided “as is” and “as available.” Celebrate Vacation may change features without notice and disclaims all warranties. No oral or written advice from Celebrate Vacation creates any warranty not expressly stated.
You authorize Celebrate Vacation representatives to contact you via phone, message, and email, superseding any Do Not Call preferences. This consent clarifies that such communications are: at your request/authorization, ‘transactional’ (not unsolicited commercial communication), and compliant with relevant telecommunication guidelines.
10. Security and Account Related Information
You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your account. You must immediately notify Celebrate Vacation of any unauthorized use of your password or account. Celebrate Vacation is not liable for losses incurred due to unauthorized use of your password or account. You should not use anyone else’s account.
Information provided may be intercepted due to security breaches at your end. Celebrate Vacation keeps credit/debit card and bank information secured and encrypted. For fraud detection or credit offerings, Celebrate Vacation may verify user information like credit score. Personal information may be shared in anonymized/aggregated form with third parties for tasks like payment processing, data hosting, or credit assessment. While Celebrate Vacation adopts industry standards for security, it cannot guarantee against all security breaches. User data may be shared with law enforcement agencies for lawful or investigation purposes without consent.
11. Fees and Payment
Celebrate Vacation reserves the right to charge convenience or service fees in addition to booking costs, and to alter fees periodically. Any additional fees will be transparently displayed to you before booking confirmation.
In cases of short charging due to technical error, Celebrate Vacation can deduct or claim the balance, and may cancel bookings if not paid before utilization. You must bear any increase in price due to tax changes or new government levies, which may be retrospective.
If a booking is unconfirmed, Celebrate Vacation will refund the booking amount but is not obligated to provide an alternate booking. Refunds from cancellations (user, service provider, or force majeure initiated) are processed as per service provider policies and subject to receipt of funds from them. Celebrate Vacation aims to process refunds within 24 hours of receipt from the service provider, and within 96 hours for transactions older than 6 months (after banking details are received).
You are responsible for all charges, fees, duties, taxes, and assessments. Payments must only be made to Celebrate Vacation’s bank accounts; Celebrate Vacation is not liable for transfers to private or unauthorized accounts. You must not share sensitive personal information (credit/debit card details, OTPs, passwords) with
any person, including Celebrate Vacation agents, unless directly through the secure and verified payment gateway on the website. Refunds are processed to the original payment instrument. Bookings are subject to applicable cancellation policies.
Celebrate Vacation provides various payment modes: UPI, Credit/Debit Cards, Net Banking, Wallets, Gift Cards, and EMI.
12. Usage of Mobile Number, Communication Details
Celebrate Vacation will send booking confirmations, itineraries, cancellations, payment/refund statuses, and other transaction-relevant information via SMS, WhatsApp, voice call, email, or other provided communication details. Celebrate Vacation may also contact Users for pending/failed bookings or to assist with booking completion.
Users unconditionally consent that such communications are: at their request/authorization, ‘transactional’ (not unsolicited commercial communication), and compliant with TRAI guidelines. Users indemnify Celebrate Vacation against losses due to erroneous complaints or wrong contact details provided.
13. Insurance
Obtaining sufficient insurance coverage is your obligation, unless explicitly provided by Celebrate Vacation. If insurance is provided, it’s under the terms of a third-party insurance company, with Celebrate Vacation acting as a facilitator. You must contact the insurance company directly for claims or disputes. Celebrate Vacation is not liable for partial acceptance or denial of claims.
14. TCS Compliance (Tax Collected at Source)
On Overseas Tour Packages: You are liable to pay Tax Collected at Source (TCS) on overseas tour packages as per Section 206C (1G)(b) of the Income Tax Act, 1961. Celebrate Vacation will deposit the TCS and issue a certificate.
You must provide a valid PAN. Celebrate Vacation will validate the PAN and may cancel bookings if invalid or not belonging to the traveler, processing refunds as per policy. If you are a ‘Specified Person’ (as per Section 206CCA), you agree to pay TCS at a higher applicable rate. Celebrate Vacation may cancel bookings if additional TCS is not paid.
15. Compliance of Liberalized Remittance Scheme (LRS)
The Reserve Bank of India (RBI) mandates PAN details for all LRS transactions, including international bookings. You warrant PAN details will be shared by the cut-off date. For minors, PAN details of the parent/guardian are required. Non-compliance may result in booking cancellation.
You confirm that the total foreign exchange remitted/purchased falls within RBI’s permissible limit. If the limit is breached, Celebrate Vacation may cancel the booking. You confirm foreign exchange purchased for international travel will be used for the stated purpose. You authorize Celebrate Vacation to retrieve/share PAN details for verification purposes. You can opt out of providing PAN details or delete them via your desktop profile.
16. Obligation to Obtain Visa
For international bookings, obtaining valid visas (including transit visas and “OK TO BOARD” approvals) is your sole responsibility. Celebrate Vacation is not responsible for issues arising from visa requirements or denial, and is not liable to refund amounts for inability to travel due to visa issues. Refunds, if any, are strictly per booking and cancellation policy. Information provided by Celebrate Vacation regarding travel documents is advisory only. You must verify requirements with airlines and relevant jurisdictions.
17. Force Majeure
Celebrate Vacation and/or Service Providers may be unable to honor bookings due to exceptional circumstances beyond their reasonable control (e.g., acts of God, labor unrest, pandemics, government decisions, technical issues, cancellations by service providers, natural disasters).
If Celebrate Vacation has advance knowledge, it will try to provide alternatives or refund the booking amount (after deducting service charges and if refunded by service operators). Celebrate Vacation, as a facilitator, is not responsible for Force Majeure events. You must contact the Service Provider directly for resolutions and refunds.
In case of non-confirmation due to technical reasons, Celebrate Vacation’s obligation is limited to refunding the booking amount, discharging all liabilities. Celebrate Vacation is not liable for direct, indirect, punitive, incidental, special, or consequential damages arising from Website use.
18. Advertisers on Celebrate Vacation, and Linked Websites
The Website may contain links to third-party websites or resources, which Celebrate Vacation does not control and is not responsible for their content. Accessing them is at your own risk. Celebrate Vacation is not responsible for errors, omissions, or representations on pages or linked sites where information is provided directly by Service Providers or advertisers.
Celebrate Vacation does not endorse advertisers or linked sites. You should verify information on third-party pages independently. Linked sites are not under Celebrate Vacation’s control, so it’s not responsible for their content or updates. Links are provided for convenience.
19. Right to Refuse Service
By Celebrate Vacation: Celebrate Vacation reserves the right to refuse any booking without assigning a reason. Services or confirmed booking details will not be provided until full payment is received.
Celebrate Vacation may limit activity, warn other users, suspend/terminate registration, or refuse access if you breach this agreement, provide unverified information, or if your actions infringe third-party rights/laws or cause liability. Suspended/terminated Users cannot re-register or use the Website until reinstated. If you breach this agreement, Celebrate Vacation can recover amounts due and take legal action. You shall not send abusive, threatening, offensive, defamatory, obscene, or unlawful content, or content violating IP rights or spam. Violation may lead to legal action. By End Service Provider: You agree that the service provider may refuse service for reasons including behavioral issues, public safety, health hazards, government orders, etc. In such cases, liability rests solely with the service provider, and claims/refunds/damages must be sought directly from them, not Celebrate Vacation.
20. Right to Cancel Bookings
You must provide correct and valid information; default may disentitle you from services. If Celebrate Vacation discovers unauthorized service requests, incorrect information, or misrepresentation, it can take legal remedies, including booking cancellation without prior intimation. Celebrate Vacation is not responsible for loss or damage caused by such cancellations.
If a judicial/government authority requests cancellation, Celebrate Vacation will comply without contacting you.1 You shall not hold Celebrate Vacation responsible for losses from measures taken to safeguard its interests or genuine customers, including denying/cancelling suspected fraudulent transactions.
21. Fake Calls and Other Similar Phishing, Spamming or Fraudulent Activities
Celebrate Vacation employees or authorized representatives will never ask for credit/debit card details, net banking logins, passwords, OTPs, or fund transfers to personal accounts. They will also not ask you to install third-party applications for screen viewing. Acting on such requests may lead to fraud and loss of money/information. You should report such demands immediately to hotels@celebratevacation.co.
22. Indemnification
You agree to indemnify, defend, and hold harmless Celebrate Vacation, its affiliates, and their respective officers and directors from any losses, liabilities, claims, damages, costs, and expenses arising from any breach of representation or warranty or non-performance by you. You are solely liable for breaches of country-specific rules, regulations, or general codes of conduct.
23. COVID-19 Related Terms & Conditions
You agree that due to the COVID-19 pandemic, service providers may cancel bookings or refuse services (e.g., if you exhibit symptoms, refuse safety advisories, are deemed vulnerable, or pose a health threat). Celebrate Vacation assumes no liability for such refusals. Refunds, if any, are processed strictly subject to receipt of funds from the service provider.
You must abide by all government guidelines and Standard Operating Procedures (SOPs) for travel (e.g., wearing protective gear, maintaining social distancing). Failure to comply may lead to disallowance of travel, with refunds strictly governed by service provider terms. You understand that downloading specific health applications (e.g., Arogya Setu App) or submitting self-declaration forms may be mandated. Bookings are subject to minimum medical well-being criteria, such as having no COVID-19 history within 28 days before travel, and you may be required to furnish medical proof or health declarations.
24. Content Moderation
Guest Review Moderation Guidelines: Only reviews from customers who booked and completed a hotel stay are accepted. Reviews may include rating, text, and/or images.
Reviews are initially auto-moderated; those failing auto-moderation are manually moderated to ensure intent/meaning/language is not changed (no grammar/spelling edits). Reasonable efforts are made to detect fake reviews; Celebrate Vacation reserves the right to delete and investigate them. No representation or warranty is made regarding review accuracy/genuineness; reliance is at your risk.
Moderation Guidelines for Content Only Reviews: Both positive and negative genuine reviews are accepted as written. Rating-only reviews are accepted. Abusive/inappropriate language, character assassinating comments, hotel price, hotel/competitor OTA comparisons, controversial/insensitive/religious comments are removed. Reviews in regional languages are accepted with English translation.
Rejected reviews include: duplicates (only two most recent accepted), no check-in reviews, fake reviews (e.g., from travel agents, non-booking), irrelevant reviews, hotel rules issues, reviews about another hotel, suspicious reviews.
Moderation Guidelines for Image Reviews: Images focusing on hotel facilities (room, bathroom, reception, dining, etc.) are accepted. Rejected images include: not hotel-related, selfies, irrelevant, inappropriate (nudity, obscenity, drugs), duplicates, screenshots, low-resolution, incorrectly tagged, upside down, watermarked.
Hotel Reply Moderation Guidelines: Both positive and negative genuine/relevant replies are accepted. Hotelier’s justification for negative reviews in appropriate language is acceptable. Rejected replies include: irrelevant, offensive, blank, containing contact details, or statements persuading customers for offers/discounts.
25. Recommendation System
Celebrate Vacation uses recommendation systems to display properties based on search form information (destination, guests, budget) and past platform usage. Property performance and ranking are based on gross bookings, net bookings, reviews, location, price, property type, and click rate. Search results are sorted by popularity by default, but you can sort by user rating or price (lowest/highest first). The system may be influenced by other customers’ platform usage and similar preferences. A “Sponsored” badge indicates a service provider has paid for higher visibility.
26. Miscellaneous
- Severability:If any provision of this agreement is found to be invalid or unenforceable, only that specific part is affected, and the remaining provisions shall remain in full force and effect.
- Jurisdiction:This agreement is subject to the laws of India. Any unresolved disputes arising from or in connection with this agreement shall be referred to the exclusive jurisdiction of the courts in Delhi.
- Amendment:Celebrate Vacation reserves the right to amend or modify this User Agreement periodically. You are responsible for regularly reviewing the policy to stay informed of any changes.
- Confidentiality:Information specified as confidential by Celebrate Vacation must be maintained confidentially by you, unless required by law or for agreement purposes.
- Feedback from Customer:You authorize Celebrate Vacation to contact you for feedback via emails, calls, SMS. You can opt out by writing to hotels@celebratevacation.co.
- Privacy Policy:You must refer to Celebrate Vacation’s Privacy Policy, and by using the Website, you consent to the use of personal information as outlined therein.
- Grievance Redressal:For unresolved concerns, you can contact the grievance officer: Neha Bisht, hotels@celebratevacation.co, 2nd Floor, Above Uphar Kendra, Bajaja Line, Ramnagar, Dist. Nainital, Uttarakhand, 244715. Please provide your booking reference and ticket ID. The officer endeavors to redress concerns within 30 days.
27. Terms of Service (Detailed sections for various services)
This section outlines detailed terms of service for various product categories offered by Celebrate Vacation. These comprehensive sub-sections are vital for providing granular legal clarity for each distinct service offering.
27.1. Flight Tickets
This subsection covers airline terms and conditions, code-share agreements, the breakdown of pricing components (base fare, taxes, convenience fee), infant fares, required travel documents, check-in procedures, rules regarding the use of flight segments, and specific policies for changes to existing bookings and refunds.
27.2. Charter
Covers terms of the charter company, facilities on board, changes to existing bookings, travel documents, and refunds.
27.3. Hotels
This section details Celebrate Vacation’s role and liability limitations concerning hotel bookings, information provided by hotels and their specific terms, user responsibilities (e.g., liability for damages, age requirements, ID proof, adherence to check-in/out times), potential additional charges levied directly by hotels (e.g., laundry, room service, mandatory meal surcharges), and payment terms (prepaid, pay at hotel, part payment, currency, security deposit).
27.4. Bus
This part explicitly states Celebrate Vacation’s role as solely a technology platform for bus bookings, outlining limitations of liability (e.g., not responsible for bus operations, conduct of employees, vehicle condition, cancellation, baggage handling, seat changes, boarding points). It must also detail user responsibilities (e.g., contacting the operator for exact boarding points, carrying ID proof, timely arrival, understanding non-transferable tickets, child fares), and ticket cancellation procedures.1
27.5. Cabs (including Self-Drive)
This section defines “Cab” and “Cab Operator.” It details types of bookings (Outstation Cab, Car Rental, Airport Drop). Covers Celebrate Vacation’s role and liability limitations (facilitator only, not responsible for timeliness, safety, vehicle condition, driver behavior, baggage loss, cancellations, accidents), payment for bookings (prepaid, part payment, additional charges like tolls/taxes, final pricing based on usage), and responsibilities of Users (ID proof, boarding on time, no changes to booking, safety of luggage, reporting issues, tourism purpose only) and “DO’s AND DON’Ts” should be included.
27.6. Tours and Attractions
This section defines “Tours and Attractions” and “Supplier.” It covers booking and use of services (availability, price fluctuation, compliance with Supplier conditions). It must detail Celebrate Vacation’s role and liability limitations (facilitator only, not responsible for damage/loss, health/safety, incidental services, incorrect info from Supplier; maximum liability limited to refund of booking amount). It should also cover responsibilities of Users (complying with Supplier terms, presenting voucher, accurate info/documents, no resale, valid travel documents, being present on time, signing waivers, meeting eligibility criteria). Payment and cancellation terms (Supplier policies, changes/cancellations through Website, refunds, taxes/fees, force majeure) should also be included.
27.7. Visa Services
This section defines Celebrate Vacation’s role and liability limitations as a facilitator only (not responsible for visa grant/rejection, not advisory, limited to informing/collecting/submitting documents, not liable for accuracy of embassy info, not responsible for approval/rejection factors, no role in interviews, may appoint third-party vendors, not liable for lost passports in transit, list of countries subject to change, not liable for acts/omissions of consulates or denial of entry, “OK TO BOARD” approvals). It must cover user responsibilities (authorizing Celebrate Vacation to file application, providing genuine/correct documents/information, checking visa details upon receipt, reapplying/appealing rejection as fresh transaction, vendor refusal based on credentials). Payment and other charges (service fee, logistics charges, embassy fees/taxes subject to change) should also be addressed.
27.8. Outbound and Domestic Tours
This comprehensive section defines “Independent Contractors,” “Outbound Tour,” “Tour Cost,” “Booking Fees,” “Brochure,” “Infant,” and “Child.” It covers Celebrate Vacation’s role and liability limitations (does not operate services, not responsible for delays/improper service/injury/death/loss from Independent Contractors or co-travelers, not liable for personal injury/sickness/accident/death/loss/delay/discomfort/increased expenses/theft, delays in service delivery, airline/hotel failures, tour manager disputes, airport delays, damages beyond control; maximum liability limited to total booking amount). It covers Brochure information (right to change info, notification of changes, price amendments due to currency/fuel/supplier charges). Covers Meals and Special Requests (pre-set menus, right to change menu, no claims for unutilized meals, no packing/room delivery of breakfast, special requests subject to service provider honor). Covers Hotels in the Outbound Tour (selection process, no claims on star category, not liable for insufficient services, User liable for damages to hotel property, no change of hotel after booking, User responsible for baggage/valuables). Covers Miscellaneous (right to withdraw tour membership for disruptive behavior, mandatory holiday insurance, transfer to another tour treated as cancellation).
27.9. Self-Drive Cabs
Defines “Cab” and “Operator.” Covers Celebrate Vacation’s role (facilitator only, not an Operator). Covers Operator’s role (provides vehicle, confirms booking, terms for renting, valid driving license required, handles handover/pickup, resolves damage disputes). 27.10. Cruise Services
This section defines “Cruise” and “Cruise Provider.” It covers booking and use of services (availability, price changes, compliance with Cruise Provider conditions, accurate information). It details Celebrate Vacation’s role and liability limitations (facilitator only, not responsible for services provided by Cruise Provider, not responsible for pick up/drop unless specified, not liable for damage/loss/injury/delay/inconvenience/deficiency/cancellation, health/safety, incidental services, incorrect info from Cruise Provider; maximum liability limited to refund of booking amount). It should also cover responsibilities of Users (complying with Cruise Provider terms, presenting voucher, accurate info/documents, no resale, valid travel documents, being present on time, signing waivers, meeting eligibility criteria, adhering to additional requirements).
